Dispensaries

Medical Marijuana dispensaries are facilities where registered patients or their caregivers can obtain marijuana for medicinal use.

Medical marijuana can be obtained from licensed non-profit producers in New Mexico to ensure the safe production, distribution, and dispensing of medical cannabis to qualified patients. Producing medical marijuana for non- qualified patients is not allowed.

Visiting a Dispensary

To visit a non-profit production or a medical marijuana facility, a patient must present a physician’s recommendation for proof that he may legally use medicinal marijuana. A caregiver must present a registry card proof that a caregiver may legally possess medical marijuana.

Starting a Dispensary

A non-profit producer must complete all required information, documentations, equipment, and required fees in order to to be accepted or to be granted a license. Failure to meet all requirements needed for the licensing process will result in denial of the application by the Department of Health. A producer must be 18 years of age or older with no background of any drug felony conviction. Dispensary locations must be at least 300 feet from any school or church.

These factors will be taken into consideration when issuing a license:

  • The service location of the applicant.
  • The applicant’s production, sales, and distribution plan.
  • The applicant’s skill and knowledge of horticulture and cannabis production technology
  • The applicant’s knowledge of current good manufacturing practice in manufacturing, packaging, labeling, or holding operations for dietary supplements, environmental protection agency agricultural worker protection standards, and New Mexico department of agriculture (NMDA) pesticide registration, licensing and use requirements to ensure a safe product and environment.
  • The applicant’s plan for the manufacture or distribution of cannabis derived products, including edibles
  • The security plan proposed, including location, security devices or equipments employed, and staffing.
  • The applicant’s quality assurance plan to ensure purity, consistency of dose, as well as the applicant’s plan for routine testing by a department approved laboratory.
  • The experience and expertise of the non-profit board members, officers and employees.
  • The applicant’s financial statement.
  • The facilities available to the applicant for production, distribution, storage, and other purposes.
  • The applicant’s ownership of the property, buildings, or other facilities identified in the production and distribution plan.
