Raymundo Marrufo, a medical marijuana patient in New Mexico just sued, for the second time, the state’s Department of Health for lack of quality delivery. Marrufo resides in Deming and has to drive 60 miles to purchase his medical cannabis in Las Cruces.

GeenWay New Mexico New Mexico MMP Patient Sues NM Department of HealthLast year, on November 20, he also sued the Border Patrol in Federal Court claiming it violates the Rohrabacher Amendment, a federal law that precludes any federal agency from using federal funds to enforce any laws that interfere with state medical marijuana laws. His lawsuits present a similarity wherein on both occasions, the Border Patrol checkpoint had asked if he was carrying illegal drugs.

According to Marrufo, it presented to be a dilemma for him by answering either yes or no, he is implicating himself for drug smuggling or lying to federal agent, respectively. The only option he has is to pay a delivery driver $40 to meet him in a restaurant or parking lot, which could still implicate them both to dangerous conditions and possible legal repercussions.

He further added, that this mess is due to the lousy planning of the geographical areas included in the marijuana program. He said that the New Mexico Department of Health just needed to look at a map to provide a better planned route and delivery for all its clientele statewide.

Raymundo Marrufo is suing the New Mexico Department of Health for negligence, breach of confidentiality and violation of due process, and an injunction forcing the state to provide safe and private delivery of medical cannabis to patients.
